Revised Common Rule: New and Updated Exempt Categories

The Common Rule is the common name for Subpart A of the federal regulations for the protection of human subjects. 45 CFR 46. On January 21, 2019, new regulations and institutional policies and procedures regarding human subjects research took effect. The changes were designed to improve research participant protections and modernize the regulations to address new ethical questions in the 21st century.

One of the biggest changes in the revised Common Rule is to research deemed “exempt” by the regulations. The regulations consider exempt research to be very low risk to participants. This may include research like conducting minimal risk surveys and interviews. The revised Common Rule has added new categories of exempt research, altered others, and made most of the categories less strict in conducting research with vulnerable groups. The new regulations have made the process of submitting exempt research and getting it approved less burdensome, and the scope of projects that can be considered exempt has become wider.
